Terms of Service
1. Agreement
These Terms of Service ("Terms") are an agreement between you and Isariya Kijdarapong, the individual developer who operates MADD – Badminton ("MADD", "we", "us"). They govern your use of the MADD apps for iOS and Android and madd-badminton.com (together, the "Service"). By downloading, accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use MADD. If you are under the age of majority where you live, you may use MADD only with the consent of a parent or guardian, who agrees to these Terms on your behalf and is responsible for your use, including any purchases.
3. Accounts
- You can join a room as a guest. Some features — such as creating an invite QR code or editing a profile — require a registered account.
- You agree to provide accurate information and to keep your login details secure. You are responsible for activity that happens under your account.
- Your MADD ID and nickname must not impersonate anyone or infringe anyone's rights. We may reclaim or change an ID that does.
- You can delete your account at any time from the Profile menu in the app.
4. The service
MADD helps badminton organizers and players manage sessions: player lists, queues, courts, game counts, rankings, cost-sharing, payment slips, messages and reviews. MADD is a tool only. We do not organize, host or supervise any badminton session, venue or event, and we are not responsible for what happens at them, including injuries, disputes, cancellations or the conduct of organizers and players.
We may add, change or remove features at any time. We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free.
5. Payments between users
MADD does not receive, hold or transfer money on anyone's behalf. Court fees, shuttlecock costs and any other amounts are paid directly between organizers and players, outside MADD.
- Cost-sharing figures shown in the app are a convenience based on information entered by users. Organizers and players are responsible for checking amounts before paying.
- Payment QR codes and transfer slips are uploaded by users. We do not verify them and are not responsible for incorrect, fraudulent or failed transfers.
- Any refund, dispute or disagreement about these payments must be resolved between the people involved.
6. Subscriptions and purchases
MADD offers optional paid features, including monthly subscription plans and one-time purchases that add usage quota. Plan names, prices, quota and features are shown in the app before you buy and may vary by country.
- Billing. All purchases are made through the Apple App Store or Google Play and are charged to the account you use with that store. Their payment terms also apply.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. Your store account will be charged for renewal within 24 hours before the end of the current period.
- Cancelling. You can manage or cancel a subscription in your App Store or Google Play account settings, or through "Manage Subscription" in the app. Cancelling stops future renewals; you keep access until the end of the current paid period. Deleting the app or your MADD account does not cancel a subscription.
- Refunds. Refunds are handled by Apple or Google under their own refund policies. We cannot issue refunds directly.
- Quota. Quota is a usage allowance within the app. It has no cash value, cannot be transferred or exchanged for money, and may expire or reset as described in the app at the time of purchase.
- Price changes. We may change prices. Changes to subscriptions will follow App Store and Google Play rules, including any notice they require.
- Restoring purchases. Use "Restore Purchases" in the app if a purchase does not appear on a new device.
7. Your content
You keep ownership of the content you add to MADD, such as your profile photo, nickname, messages, reviews, payment QR codes and transfer slips ("Your Content"). You give us a worldwide, non-exclusive, royalty-free licence to store, display and process Your Content only as needed to operate and improve the Service, including showing it to the people in your sessions. This licence ends when Your Content is deleted, except where others have already received it as part of normal use.
You are responsible for Your Content and confirm you have the right to share it. Only upload payment slips and personal details that you are entitled to share.
8. Acceptable use
You agree not to:
- Harass, threaten, abuse or discriminate against other users
- Post content that is unlawful, hateful, sexual, violent or infringes others' rights
- Upload fake payment slips or use MADD to deceive or defraud anyone
- Share other people's personal information without permission
- Impersonate any person or misrepresent your identity
- Interfere with the Service, bypass its security or quota limits, or access it with bots, scrapers or modified apps
- Reverse engineer, copy or resell the Service, except where the law expressly allows
You can report abusive content in the app. We may remove content and suspend or terminate accounts that break these Terms.
9. Our intellectual property
The Service, including its design, software, logos and the MADD name, belongs to us and is protected by law. We grant you a personal, non-transferable, non-exclusive, revocable licence to use the MADD app on devices you own or control, for your own non-commercial purposes in organizing or joining sessions, in line with these Terms and the rules of the store you downloaded it from.
10. Termination
You may stop using MADD and delete your account at any time. We may suspend or end your access if you break these Terms, if required by law, or to protect users or the Service. Sections that by their nature should continue — including 5, 7, 11, 12 and 14 — survive termination.
11. Disclaimers
To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that rankings, queues, game counts or cost calculations will be accurate or complete. Badminton is a physical activity; you take part at your own risk.
12. Limitation of liability
To the extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or money, arising from your use of the Service, from payments between users, or from the conduct of other users. Our total liability for any claim related to the Service is limited to the amount you paid us for the Service in the 12 months before the claim, or USD 50 if you paid nothing. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer under the laws of your country.
13. Changes to these Terms
We may update these Terms from time to time. We will change the effective date above and, for significant changes, let you know in the app. Continuing to use MADD after the changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of Thailand. Any dispute will be handled by the competent courts of Thailand, unless the laws of your country give you the right to bring a claim where you live.
15. App store terms
Apple App Store
If you downloaded MADD from the Apple App Store, you and we acknowledge that:
- These Terms are between you and us only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the app and its content.
- Your licence to use the app is limited to Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be used by other accounts associated with you through Family Sharing or volume purchasing.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) of the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses due to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple will have the right to enforce these Terms against you as a third-party beneficiary.
Google Play
If you downloaded MADD from Google Play, the Google Play Terms of Service also apply to your use of Google Play. Google is not a party to these Terms and is not responsible for the app.
